1. Overview
These Terms & Conditions apply to the hire of the Brew Bin mobile kegerator unit supplied by Sparge Pty Ltd (“we”, “us”, “our”).
By booking a Brew Bin, you (“the Hirer”) agree to these Terms.
The Brew Bin remains the property of Clarendon Brewing at all times.
2. Private Hire Only
The Brew Bin is supplied for private functions only.
Beer supplied with the Brew Bin:
- Must not be resold
- Must not be supplied at ticketed or public events without prior written approval
- Must not be used for commercial on-selling
If the event is found to be public, ticketed, or commercial without disclosure, we reserve the right to cancel the booking without refund.
3. Liquor Licensing Compliance (South Australia)
Alcohol is supplied by Clarendon Brewing (Liquor License # 30690) under its South Australian liquor licence and remains under the control of the licensee until service.
The Hirer agrees that:
- Alcohol will not be supplied to persons under 18 years of age
- Intoxicated persons will not be served
- The event will comply with the Liquor Licensing Act 1997 (SA)
- Alcohol will not be removed for resale
The Hirer is responsible for supervising alcohol consumption at the event.
We reserve the right to refuse or cease supply if liquor laws are breached.
4. Responsible Service & Supervision
The Hirer must:
- Nominate a responsible adult (18+) to oversee service
- Ensure responsible consumption
- Provide access to food and water
- Prevent rapid or excessive intoxication
- Immediately comply with any direction from police or authorised officers
5. Equipment Supplied
The Brew Bin unit includes:
- Wheelie bin kegerator (“The Brew Bin”)
- Beer taps and fittings
- CO₂ gas cylinder and regulator
- Beer lines
- Associated components
Only beer supplied by Clarendon Brewing may be connected unless agreed in writing. Unopened kegs remain the property of Clarendon Brewing and must not be removed, transferred, or supplied outside the approved event location.
6. Use & Safety Conditions
The Hirer must ensure:
- The unit remains upright at all times
- Indoor or fully weather-protected use only
- Placement on level ground
- No unauthorised modification, repair, or adjustment
- Gas components are not tampered with
The Brew Bin must not be transported by the Hirer unless agreed in writing.
Children must not operate taps or access controls.
7. Delivery & Access
The Hirer must provide:
- Safe, level access for delivery and collection
- Clear access free of obstacles
If delivery or collection is delayed due to unsafe or restricted access, additional fees may apply.
8. Hire Period
The hire period is agreed at the time of booking.
Our standard hire period is 12 hours from the time of drop-off or pickup, unless otherwise agreed.
Additional charges apply if equipment is not available for collection at the agreed time.
9. Cleaning
The Brew Bin must be returned:
- In reasonably clean condition
Excessive cleaning will incur a cleaning fee.
10. Damage, Loss & Theft
The Hirer is responsible for all loss, theft, or damage to The Brew Bin and associated equipment during the hire period.
This includes, but is not limited to:
- Gas cylinder loss or damage
- Regulator or tap damage
- Keg loss or damage
- Structural damage to the Brew Bin
- Water damage caused by improper drainage or use
The Hirer is liable for the reasonable cost of repair or replacement (including parts and labour).
Where repair is not possible, replacement cost will be based on current market value.
Where costs exceed the bond amount, the Hirer remains liable for the balance.
11. Bond
A refundable bond is required prior to hire.
The bond may be retained in part or full for:
- Damage
- Theft
- Missing components
- Excessive cleaning
- Breach of these Terms
Bond refunds are processed following inspection.
12. Weather & Environmental Conditions
The Brew Bin must not be exposed to:
- Rain
- Direct hose water
- Flooding
- Excessive heat without shade
Damage caused by weather exposure is the Hirer’s responsibility.
13. eCup Hire
If the Hirer chooses to hire Clarendon Brewing branded reusable eCups:
- eCups are hired at a fee of $1.00 per cup.
- Lost, stolen, or damaged eCups will incur a replacement fee of $2.00 per cup.
The Hirer is responsible for:
- Ensuring all eCups are returned at the end of the hire period
- Returning cups stacked neatly in manageable piles
- Removing excess liquid and debris before return
Replacement costs may be deducted from the bond.
14. Limitation of Liability
To the maximum extent permitted by law:
- Use of The Brew Bin is at the Hirer’s risk
- We are not liable for injury, property damage, event disruption, lost profits, or consequential loss
- Liability is limited to the hire fee paid
Nothing in these Terms excludes rights under the Australian Consumer Law.
15. Cancellation Policy
Cancellations:
- More than 7 days prior: Full refund of hire fee
- 2–7 days prior: 50% hire fee retained
- Less than 48 hours: 100% hire fee retained
16. Refusal of Service
We reserve the right to refuse or cancel hire where:
- Liquor laws may be breached
- The event poses safety risks
- False or misleading information was provided
- Payment terms are not met
17. Indemnity
The Hirer indemnifies and holds harmless Sparge Pty Ltd and Clarendon Brewing from any claims, penalties, fines, or damages arising from:
- Breach of liquor laws
- Injury caused by misuse
- Failure to supervise alcohol service
- Unauthorised relocation or modification of equipment
